What sellers must hand over

Under SB 2204 (NDCC chapter 47-10, signed 17 April 2025), sellers must disclose in writing what they know about radon levels. They must also give the buyer a state-worded radon warning statement to sign, plus any past test results and mitigation records.

If the house already has a radon system, ask for the install paperwork and the last test.

What the law does not do

It does not require a test and it does not give the buyer a right to cancel. If you are buying in Bismarck, Mandan or Lincoln, order a test as part of the inspection period anyway.

With a Burleigh County survey rate of 47% and Morton County at 53%, an untested house is a coin flip.

Testing during a sale

Closed-house conditions matter during the test. Use a continuous monitor, which a home inspector may add for about $150, or a professional test costing up to $800 nationally.

If the result is 4 pCi/L or higher, a system can often be negotiated into the sale or installed before closing.
